These Terms of Service ("Terms") govern your access to and use of LEADUS, a software platform operated by the operator of LEADUS ([to be provided by the LEADUS owner]) ("LEADUS", "we", "us").

By creating an account or using LEADUS you agree to these Terms. If you do not agree, do not use the service.

1. What LEADUS is

LEADUS is a lead-generation and customer-acquisition platform. It helps users discover businesses, review publicly available business information, organise those businesses as leads, evaluate the quality of a business's online presence, and manage lawful business outreach through supported communication channels.

LEADUS is a software tool only. It does not act as your agent, does not send messages on your behalf without your action, and does not guarantee sales, customers, revenue, replies, or successful outreach of any kind.

2. Who may use LEADUS

  • You must be old enough to form a binding contract in your jurisdiction, and at least 18 years old.
  • You must use LEADUS for business, marketing, research, sales, or other lawful purposes.
  • If you use LEADUS on behalf of an organisation, you confirm you are authorised to accept these Terms for that organisation.

3. User accounts

When you register and maintain an account you agree to:

  • Provide accurate registration information and keep it current.
  • Keep your login credentials secure and confidential.
  • Not impersonate another person or organisation.
  • Not create accounts for fraudulent, deceptive, or abusive purposes.
  • Not share your account in a way that violates your applicable plan.
  • Notify us promptly if you become aware of unauthorised access to your account.

3.1 Account enforcement

We may suspend or terminate accounts involved in abuse, fraud, illegal activity, security threats, or serious or repeated violations of these Terms.

4. Acceptable use

You may use LEADUS only for legitimate business, marketing, research, sales, and other lawful purposes. LEADUS must never be used as a tool for scams or fraudulent outreach.

The following are strictly prohibited:

  • Fraud, scams, phishing, or identity theft.
  • Impersonation of any person, business, government body, or financial institution.
  • Deceptive commercial practices or misleading offers.
  • Harassment, threats, or extortion.
  • Money laundering or facilitating any illegal activity.
  • Distributing malicious software or attempting to steal credentials.
  • Spam campaigns and mass unsolicited abuse.
  • Circumventing platform restrictions, rate limits, or account restrictions.
  • Abusing third-party services or integrations.
  • Scraping or data collection in violation of applicable law or third-party terms.
  • Any activity intended to harm businesses or individuals.

5. Outreach rules

You are solely responsible for every message you send using or arising from LEADUS. When conducting outreach you must:

  • Identify yourself honestly and accurately represent your business or service.
  • Avoid misleading claims about results, affiliations, endorsements, or capabilities.
  • Never pretend to represent another company, LEADUS, or any third party.
  • Respect any recipient request to stop receiving communication, promptly and permanently.
  • Comply with applicable advertising, electronic communications, privacy, and anti-spam laws.
  • Never send abusive, threatening, deceptive, or fraudulent messages.

5.1 No authorisation for unlawful messaging

Nothing in LEADUS authorises you to send unlimited or unlawful unsolicited messages. Any messaging volume made technically possible by the platform is not an authorisation to exceed what applicable law and the relevant communication channel permit.

6. WhatsApp, email, and other channels

You are responsible for complying with the rules, policies, and laws applicable to whichever communication channel you use, including any third-party messaging or email provider's own terms.

LEADUS does not guarantee delivery, replies, or acceptance of messages by third-party communication platforms. If a third-party provider restricts, blocks, or suspends your account, LEADUS is not responsible for that decision where LEADUS did not cause it.

7. Public business information

LEADUS may display business information that is publicly available or obtained through authorised integrations and services. This may include business name, category, location, rating, review count, public business contact details, public website information, and public business profile information.

You may use such information only for lawful purposes. Business information changes over time and may be incomplete, outdated, or inaccurate. LEADUS does not warrant that any record is accurate or current, and you should independently verify important information before relying on it.

8. User content

You may create messages, campaigns, notes, lead lists, business descriptions, and other content within LEADUS. You remain responsible for the content you create, store, or send.

You must not submit unlawful, fraudulent, malicious, infringing, or deceptive material. You retain your rights in your content, and grant us only the limited rights needed to host, process, and display it so we can provide the service.

9. Intellectual property

LEADUS branding, software, interface, design, logos, documentation, and content created by LEADUS are owned by us or our licensors.

While your account is active and in good standing, you receive a limited, non-exclusive, non-transferable right to use the service. You do not acquire ownership of the LEADUS software or brand.

10. Third-party services

LEADUS relies on third-party services to operate, which may include mapping and business-data providers, email providers, communication providers, payment providers, authentication providers, and cloud infrastructure providers.

Those services have their own terms and privacy policies. LEADUS does not claim ownership of third-party data and is not responsible for third-party service availability or decisions.

11. Suspension and termination

We may suspend, restrict, or terminate an account where reasonably necessary because of fraud, abuse, illegal activity, spam, security threats, repeated Terms violations, attempts to circumvent platform restrictions, or conduct that threatens LEADUS, its users, or third parties.

Where appropriate we will give you notice and an opportunity to resolve the issue, except where immediate restriction is reasonably necessary for security, legal, or abuse-prevention reasons. You may stop using LEADUS and close your account at any time.

12. Disclaimers

LEADUS is provided on an "as is" and "as available" basis. To the extent permitted by applicable law, we do not guarantee:

  • Leads, sales, revenue, or client acquisition.
  • Outreach response rates or message deliverability.
  • The accuracy or completeness of every business record.
  • The availability, performance, or continuity of third-party services.
  • Continuous, uninterrupted, or error-free operation.

13. Limitation of liability

To the extent permitted by applicable law, LEADUS and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost business opportunities, or lost data arising from your use of the service.

To the extent permitted by applicable law, our total aggregate liability arising out of or relating to the service in any twelve-month period is limited to the amounts you paid us for the service during that period.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.

14. Changes to these Terms

We may update these Terms from time to time. Each version is dated and versioned. Where an update is material, we will mark the new version as requiring acknowledgement, and you will be asked to review and accept it before continuing to use LEADUS.

Continued use after a non-material update means you accept the updated Terms.
